Al Ghurair Investment LLC takes privacy seriously. Al Ghurair Investment LLC’s business is organised around strategic sector themes such as mobility, infrastructure, foods, etc. This privacy notice applies to all the sector themes within Al Ghurair Investment LLC (“Al Ghurair).

Al Ghurair ("we”, “our”, or “us”) are committed to respecting your Personal Data and complying with the relevant laws including, without limitation, the United Arab Emirates Federal Decree Law No. 45 of 2021 on Personal Data Protection (“UAE PDPL”), the Dubai International Financial Centre Law No. 5 of 2020 on Data Protection (“DIFC DPL”) and European Union General Data Protection Regulation 2016/679 (“GDPR”) (“applicable legislation”). This Privacy Notice has been prepared with reference to applicable legislation considerations and will be augmented by jurisdictional specific addendums from time to time.

These are the general Terms & Conditions governing your access and use of the Al Ghurair Property Management website, Tenant, Supervisor Mobile Application and Portal .

We may collect Personal Data from you by electronic and/or physical means in the course of our business, when you contact us or request information from us, when you use our Online Services, or as a result of your relationship with any of our personnel or clients.

The Personal Data that we process includes:

• basic details, such as your first & last name, nationality, date of birth, role/title, employer/s, your relationship to a person, your contact information (such as your email address, physical address, contact details, mobile number & landline number, office number, fax number, P.O. Box Number) and other information related to the emergency contact person, such as:
  - Name of person.
  - Mobile or landline number of contact person.
  - Email ID of contact person.
• biometric data for the purpose of authentication in mobile apps;
• technical information (including your location, IP address, browser details, traffic data, location data), such as information from your visits to our Online Services (page interaction information, length of visits, etc.), or in relation to marketing emails we send to you;
• information relating to your visits to our offices or our meetings and events, including appointment details (e.g. time, location, participants) or photographic and video images;
• call recording if you reach out to us by phone, for quality and training purposes;
• Personal Data provided to us by or on behalf of our clients/customers, or generated by us in the course or providing services to them, which may include special categories of Personal Data such as health information (“Sensitive Personal Data”);
• any other information relating to you which you may provide to us.

We may collect your Personal Data:

• as part of our new business intake and client on-boarding or client maintenance activities;
• when you seek employment from us, as part of our new employee on-boarding and maintenance of the employment relationship;
• when you provide (or offer to provide) services to us, either yourself or on behalf of your employer;
• when we are acting on a matter where you or your employer are a party to the same;
• when you interact with our Online Services, or use any of our online services;
• when you interact with us in respect of any of our marketing communications or events.

We collect most of this information directly from you, through your use of our Online Services operated by Al Ghurair business, or any service provided by Al Ghurair. Furthermore, we may run pages and accounts in various social media sites to inform and engage with our customers and general public. We may monitor and record comments, reactions or visual representation of emotions made on these channels about us to improve customer experience.

We work closely with third parties (including, business partners, vendors, suppliers, sub-contractors, advertising networks, analytics providers, search information providers, customer survey providers, etc.) and may receive information about you from them. Where we obtain your information from a third party, we may ask them to provide you with a copy of this Privacy Notice to ensure that you know we are processing your information and the purpose for such processing.

The information you provide may be confidential, and we will maintain such confidentiality and protect your information in accordance with our professional obligations and applicable legislation. Al Ghurair Property Management is the brand name of Al Ghurair Properties, a limited liability company registered in the United Arab Emirates. The website and the Mobile Applications are preserved and operated by Al Ghurair Property Management.This page states the terms and conditions entered with the company or any of its associates pertaining to commercial lease, apartments or area in Al Ghurair Property Management projects in respect of which this application is used together with any documents they specifically incorporate by reference (“Terms of Use), govern the access to and use of the https://alghurairpropertymanagement.com/ (“ website and “tenant portal”) and Mobile Applications on Appstore. This comprises of any content, services on or from the website , Mobile applications or the tenant portal. Before accessing the Mobile Applications, Website or the Tenant portal, please read the ‘Terms of Use’ carefully. IF YOU DO NOT ACCEPT THE TERMS AND CONDITIONS STATED HERE, PLEASE DO NOT USE THE MOBILE APPLICATIONS, WEBSITE OR THE TENANT PORTAL.

We always process your Personal Data for a specific purpose and only process the Personal Data which is relevant to achieve that purpose. The purposes for which we process your Personal Data are as follows:

• providing professional services where this is necessary or appropriate;
• processing your orders;
• communicating with you in connection to your request;
• verifying your identity and information in your job application, and
• managing the accounts you hold with us.

We may also use your Personal Data to personalise the marketing messages we send to you and to make them more relevant and interesting, as this is in our legitimate business interests. Where required under applicable legislation, we will obtain your consent first. We may use your Personal Data for this purpose in the following ways:

Al Ghurair Property Management reserve the right to change the ‘Terms of Use’, and all new changes shall be effective immediately. If you continue to use the Mobile Applications, website or the tenant portal after updating the ‘Terms of Use’, means you agree and accept any of those new changes or modifications. We advise you to keep checking this page regularly to be aware of any changes made to the ‘Terms of Use’.

Whether we receive your Personal Data directly from you or from a third party, we will only use your Personal Data if we have obtained your consent (where this is required under applicable law), or if we have another lawful basis upon which to do so.

Depending on the purpose of the processing activity, the legal basis for the processing of your Personal Data will be one of the following (depending on the jurisdiction):

We have the right to change or update the mobile applications, website and the Tenant Portal without any prior notice. We can also restrict or block certain access to some parts or all the Mobile applications, website and the tenant portal to any user, including the registered users for any specific reason. You are responsible for ensuring that all other parties who has access to the mobile applications, website or the tenant portal through your private internet connection is aware of these terms of use and should comply with them. You may be asked to provide certain registration details to access the mobile applications, website or when paying for a specific service using personal credit cards or other forms of electronic payment. You should be responsible in providing the correct details including, without limitation, credit card or debt card information. You agree that all the details you will provide on the mobile applications, website or tenant portal is correct, current, and complete without any  missing important information.

You are responsible in securing your credential details when entering your personal information, such as your user name and password or any other piece of information in the mobile applications, website or in the tenant portal. You accept that your account is private to you and should not agree  to share it to with any individual that you do not trust. You agree to inform us immediately if any unauthorized person tried to access your account by using your username and password. You also should ensure that you sign off from your account when you finish your session to avoid any fraudulent activity targeting your account. DO NOT USE MORE THAN ONE ACCOUNT as it will result in a breach of these Terms of Use. We have the full authority to remove, disable any username or password, whether created by you or provided by us at any time for any or no reason. The mobile application and website is fully secured as it uses SSL technology, hence that, the information can only be viewed by us. If your browser is equipped with SSL, then your transactions will be automatically secured. Please consult your browser’s security specifications if you encounter any issues.

Where we process your Personal Data based on your consent, you have the right to withdraw your consent at any time. To withdraw your consent, please contact us using the contact details stated at the end of this Privacy Notice. Once Al Ghurair has received notification that you have withdrawn your consent, we will no longer process your Personal Data for the purpose(s) to which you originally consented unless there is another legal basis for the processing. Please note that where Al Ghurair relies on your consent to process your Personal Data and you choose to withdraw your consent, your decision may affect our ability to provide our Online Services and our other products and services.

The overall mobile application content, website contents, features (including but not limited to all details, software, copies, imageries, videos and artworks ) are fully owned by Al Ghurair Property Management and are strictly protected by the United Arab Emirates and International copyright, trademark, and other intellectual property rights laws. This page states the terms and conditions under which you may use the mobile applications, website for your personal reference only. Please do not copy, change, modify, create plagiarism, reshare, download, save or communicate any of the materials on our mobile application, website or tenant portal, except as follows;

• You can store files that are automatically cached by your mobile application, website browser for display improvement purposes.
• You can download or print a reasonable number of mobile application screen or pages for your own personal reference, and not for publication or distribution.
• Your personal device or computer may store copies in Random- Access Memory ( RAM) after accessing and reading those materials.
• You may download a single copy to your mobile devices or personal computer or mobile for your own personal reference.
• You can share, repost any social media updates given this feature is available in all social media channels.

You do not have the right to change copies of any available materials from this mobile application, website or republish any contents from this mobile application or website into another external mobile application or website (print, digital, etc). You are also not allowed to use any illustrations, images, videos or any other artworks, copyright, trademarks from the copies of the materials from the mobile application or website. All rights and contents on this mobile application or website are fully reserved by the company. Any suspicious activities may lead to serious consequences as it violates the copyright,
trademark and other laws.

The Al Ghurair Online Services will be managed and operated from the UAE. The information collected from you via the Online Services will be processed internally and stored on servers based in the UAE. It is not transferred outside the UAE in the usual course of our business.

We will only transfer your data outside of the UAE if:

• the country or location we are transferring your Personal Data is providing an adequate level of protection as approved by the relevant data regulator.
• the third party to which the Personal Data is transferred has provided appropriate safeguards that ensure the security of your Personal Data, in line with applicable legislation, such as the execution of Standard Contractual Clauses approved by the European Commission and DIFC Commissioner of Data Protection;
• we have your explicit consent to the proposed data transfer after being informed of any potential risks; or the transfer is necessary for one of the other reasons under applicable legislation.

Al Ghurair Properties and Al Ghurair Property Management logos, brand names, design, product or service names, slogans are trademarks of the company, and you must not use it without any official written permission from the company.

Under certain conditions you may have the right to require us to:

• provide you with further details on the use we make of your Personal Data;
• confirm whether we process Personal Data about you and (where this is the case) provide you with access to the Personal Data we hold about you;
• update any inaccuracies in the Personal Data we hold about you;
• delete any of your Personal Data that we no longer have a legal basis to use;
• where processing is based on consent, stop that processing by withdrawing your consent (which you may do at any time);
• object to any processing based on our legitimate interests unless our reasons for undertaking that processing outweigh any prejudice to your data protection rights, or object to direct marketing purposes;

• To participate in restricting anyone to enjoy the use of the mobile application or website or may harm the company’s mobile application, website or tenant portal by any means.
• Use any application, or robot to access the mobile application or website back end for any purpose, including copying or monitoring the materials.
• Users any applications, or software that harms the functionality of the mobile application or website
• Use any viruses, worms, or any other harmful activities to damage the Mobile Application and Website.
• Attempt to obtain any unauthorized access or damage any parts of the Mobile Application and Website.
• Attempt to interfere with the proper working of the Mobile Application and Website.

Al Ghurair does not knowingly collect the information of, or make contact with, children, including to participate in customer research activities. If you are aged 21 or under, please obtain your parent/guardian’s permission before you provide any Personal Data via the Al Ghurair Online Services. Users aged 21 or under without such consent are not allowed to provide us with Personal Data.

We do not warrant the completeness of the information in the Mobile Application and Website, and any reliance you have on such information is at your own risk. We disclaim all the responsibilities arising from any trust placed on such materials by you or any other user of the Mobile Application and Website, or by anyone who may be notified of any of its contents. Al Ghurair Property Management reserve the right, without any liability, to amend or extend anytime the completion date of its projects or the expected complete dates mentioned through the Mobile Application and Website.

We will be consistently updating the contents on the Mobile Application and Website or in the tenant portal if there are any. Some of the materials on the Mobile Application and Website maybe outdated, and there will be no obligation from our side to update such materials

We will retain your Personal Data for the length of time needed to fulfil the purposes for which the Personal Data was collected, unless we specifically agree a longer retention period with you, or a longer retention period is required or permitted by applicable legislation.

Our retention periods are based on the requirements of relevant applicable legislation and the purpose for which the Personal Data is collected and used, taking into account legal and regulatory requirements to retain the Personal Data for a minimum period, limitation periods for taking legal action, good practice and our business purposes. In addition, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve such purposes through other means.

However, some of your Personal Data may be retained in some circumstances, such as to resolve disputes, troubleshoot problems, enforce terms and conditions or as required by regulators. Further, in some circumstances such Personal Data is never entirely removed from databases due to technical constraints and systems back-ups.

All information we gather in this Mobile Application and Website is subject to our Privacy Policy. By using the Mobile Application and Website, you agree to accept all actions taken by us in accordance to our Privacy Policy.

If you need to access the Mobile Application and Website from outside the country, you do so on your own responsibility in compliance with the local laws.

Al Ghurair does not use profiling (where an electronic system uses personal data to try and predict something about you) or automated decision making (where an electronic system uses personal data to make a decision about you without human intervention).

Accessing this Mobile Application and Website make you accept the laws of the United Arab Emirates and the Laws of the Emirates of Dubai

Al Ghurair Property Management will not be liable for any damages caused by viruses that may infect your computer, software programs, or data while downloading materials using the mobile application and website. You understand that the use of this mobile application and website or the app is at your own risk, and there are no warranties provided by us
nor anyone working within the company should give any warranties for the same matter.
The company disclaims all type of warranties at all times.

Whilst this Privacy Notice describes the data protection practices adopted by us generally across the UAE (mainland and DIFC) and EU, local data protection laws may vary and our operations in some countries may mean that we are subject to different, or additional, local data protection requirements.
